Terms of Service

These terms govern your use of the Tora eCom website and software services (the "Service") offered by the entity operating Tora eCom. By creating an account, accessing, or using the Service, you agree to these terms. If you are accepting on behalf of a company, you represent you have authority to bind that company. The governing law and dispute venue below are placeholders; replace them with the provisions your lawyer approves (for example, Morocco and competent courts, or as agreed in a separate contract).
The service
Tora eCom provides cloud software for e-commerce order and delivery management, team workflows, and related integrations, as described in our product materials and any order or subscription you place with us. We may add, change, or discontinue features, subject to the terms of your plan and any separate agreement.
Account and access
You must provide accurate information and keep credentials secure. You are responsible for activity under your account. We may suspend or cancel access for breach, risk to the service, or non-payment as permitted by your agreement. You are responsible for your staff and agents who use the Service under your account and for ensuring that their use complies with these terms and applicable law.
Acceptable use
You must not misuse the Service. Without limitation, you will not: attempt to gain unauthorized access, interfere with the Service, spread malware, reverse engineer or circumvent technical limits where prohibited, use the Service to break the law, harass others, send unlawful spam, or process personal data you have no right to use. You are responsible for compliance with export and sanctions law where your use may be restricted.
Your content and our intellectual property
You retain rights to the data and content you submit, subject to the license you grant us to run, back up, improve, and support the Service as set out in our customer agreement or documentation. The Service, brand, and related materials are owned by Tora eCom and its licensors. Except for the rights we expressly grant, we reserve all rights. Feedback you give us may be used by us without obligation to you.
Disclaimers
To the maximum extent allowed by law, the Service is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, including fitness for a particular purpose, non-infringement, or interrupted or error-free operation. Integrations (including with carriers, Shopify, WooCommerce, and Meta / Facebook) are subject to their availability, policies, and your configuration.
Limitation of liability
To the maximum extent allowed by law, in no event shall Tora eCom, its suppliers, or affiliates be liable for indirect, incidental, special, consequential, or exemplary damages, or for loss of profit, data, or goodwill, arising from your use of the Service. Our aggregate liability for all claims in any twelve (12) month period related to the Service, unless a separate signed agreement states a different cap, shall be limited to the amount you paid us in fees for the Service in that period, or, if you use a free offer, a modest fixed amount as we may set in a future version of this document, subject to what local law permits.
Indemnity
You will defend and indemnify Tora eCom and its team against third-party claims, damages, and costs (including reasonable legal fees) arising from your use of the Service, your data, or your violation of these terms, except to the extent caused by our willful misconduct where the law disallows a broader indemnity.
Governing law and jurisdiction
This placeholder section should be completed by your counsel. Example: “These terms are governed by the laws of Morocco, excluding conflict-of-law rules. The courts of [place] have exclusive jurisdiction, without prejudice to any mandatory rights you have as a consumer in your home country or any mandatory business-to-business terms if applicable.”
